U.S. Supreme Court to Consider Case with Implications on City Resource Oversight
City of Ontario v. Quon
The United States Supreme Court has agreed to consider the case of City of Ontario v. Quon. The grant of review is encouraging as it provides an opportunity to overturn a bad decision from the Ninth Circuit Court of Appeals. The court concluded the city of Ontario violated the Fourth Amendment when it reviewed an employee’s personal text messages that were sent on a city-issued pager.

Cities to Share First Ever Statewide Report on Local Streets and Roads Condition
$71 Billion Statewide Shortfall Projected Over the Next 10 Years
A recent study found that California’s local streets and roads are at risk and that the condition will rapidly deteriorate further without a major statewide investment. The study, conducted by the League, California State Association of Counties (CSAC), County Engineers Association of California and other key local transportation stakeholders will be the topic of discussion at council meetings and media events in January.

U.S. House of Representatives Adopts the Jobs For Main Street Act, Senate Action Pending
The House of Representatives this week passed the Jobs for Main Street Act of 2010. Passed on a vote of 217-212, the legislation would direct $75 billion in Trouble Asset Relief Program (TARP) to infrastructure and public sector job investments in a second effort to recharge sluggish economic growth. The legislation also provides another $79 billion in additional relief funding for individuals and families impacted by the sluggish economic recovery.

CaliforniaFIRST is a property assessment-based financing program for the installation of energy efficiency upgrades and clean energy facilities on private property pursuant to California’s Clean Energy Municipal Financing Law, AB 811. 21 The American Recovery and Reinvestment Act of 2009. NEW DEADLINE and updated information for the three State Energy Program competitive solicitations totaling up to $95 million. (Prior deadline was Nov. 30.) Local jurisdictions, non-profits or private organizations can submit to the California Energy Commission (CEC) their proposals for the Municipal Financing Program ('AB 811-type programs'), the California Comprehensive Residential Building Retrofit Program, and the Municipal and Commercial Building Targeted Measure Retrofit Program.
